Welcome to SalaryLabs. These Terms of Service ("Terms") govern your use of our salary insights platform and related services (the "Service") operated by SalaryLabs ("we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access the Service.

2. Description of Service

SalaryLabs provides a comprehensive salary insights platform that offers:

  • Salary benchmarking and compensation analysis
  • Job market analytics and trends
  • Background check services
  • Professional salary reports and data visualization
  • Credit-based access to premium features
  • Subscription-based service tiers

3. User Accounts

3.1 Account Registration

To access certain features of our Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We may terminate or suspend your account at any time for violations of these Terms or for any other reason at our sole discretion. You may also terminate your account at any time by contacting us.

4. Credits System and Payments

4.1 Credits System

Our Service operates on a credit-based system where different features require different amounts of credits:

  • Background Check: 5 credits per search
  • Salary Data Search: 3 credits per query
  • Job Market Analytics: 2 credits per report
  • Salary Benchmarking: 5 credits per report

4.2 Subscription Plans

We offer multiple subscription tiers with different credit allocations and features. Subscription fees are billed in advance on a monthly basis and are non-refundable except as required by law.

4.3 Payment Processing

Payments are processed through Stripe. By providing payment information, you authorize us to charge your payment method for the applicable fees. You are responsible for keeping your payment information current.

4.4 Credit Expiration

Credits may expire according to your subscription plan terms. Unused credits typically do not roll over between billing periods unless specified in your plan.

5. Acceptable Use

5.1 Permitted Use

You may use our Service for legitimate business purposes, including salary research, market analysis, and background verification, in compliance with applicable laws and regulations.

5.2 Prohibited Activities

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or extract data from our Service
  • Share your account credentials with others
  • Submit false, misleading, or inaccurate information
  • Interfere with or disrupt the Service or servers
  • Use the Service to harass, abuse, or harm others

6. Data and Privacy

6.1 Data Accuracy

While we strive to provide accurate and up-to-date information, we do not guarantee the accuracy, completeness, or reliability of any data provided through our Service. You should verify information independently before making business decisions.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or business use, subject to these Terms.

8. Disclaimers and Limitations

8.1 Service Availability

We strive to maintain high availability but do not guarantee that the Service will be available at all times. The Service may be subject to maintenance, updates, or interruptions.

8.2 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SALARYLABS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Background Check Services

9.1 Service Description

Our background check service searches publicly available court records in Hong Kong. This service is intended for legitimate employment screening purposes only.

9.2 Compliance Requirements

You agree to use background check services in compliance with all applicable laws, including but not limited to employment laws, privacy laws, and anti-discrimination laws. You are responsible for obtaining appropriate consent before conducting background checks.

9.3 Accuracy and Completeness

Background check results are based on publicly available information and may not be complete or current. We recommend verifying information through additional sources and following proper due diligence procedures.

10. Indemnification

You agree to defend, indemnify, and hold harmless SalaryLabs and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be interpreted and governed by the laws of Hong Kong, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect, and the invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
